This webcast seminar explains the actions that the financial institution must take to protect the financial institution’s interests and the actions that the financial institution is prohibited from taking. We will examine the steps (and pitfalls) that financial institution employees should be aware of with respect to Chapters 7, 11 and 13 of the Bankruptcy Code. This webcast seminar will focus on the basics, but it will also serve as a good refresher for those who are familiar with the bankruptcy process.

  • What is the automatic stay and what does it prohibit?
  • What happens at a Section 341 hearing?
  • When is the financial institution required to file a proof of claim?

  • What can the financial institution do after the debtor is discharged?

Presenter:

Adam LaBoda, Esq. is an attorney with Spencer Fane Britt & Browne LLP where he specializes in the representation of financial institutions.

Adam was awarded his juris doctor from the University of Kansas Law School. Prior to joining Spencer Fane, Adam served as a law clerk for Chief Judge Lee M. Jackwig, United States Bankruptcy Court for the Southern District of Iowa. He is a member of the Missouri Bar and the Kansas Bar Associations, as well as a member of the Kansas and Missouri Bankers Associations, and the Kansas City Bankruptcy Bar Association. He is licensed to practice law in Missouri and Kansas, as well as the federal district courts in Kansas and the Western District of Missouri.
